Michelle Mayne Davis has been in practice since 1994, starting her career with the Houma law firm St. Martin & Lirette practicing in personal injury, maritime, mass tort/class action litigation, probate and successions.   In 2000, she moved to St. Tammany Parish, and became the sole Northshore attorney for the Metairie-based firm, Dwyer & Cambre, practicing commercial, real estate and construction transactions and litigation, estate planning and probate and successions.  In August 2008, she joined forces with Mark Duncan, another attorney from that firm, to establish Davis & Duncan, LLC.  She has degrees from the University of New Orleans and Loyola Law School, where she was on the Loyola Law Review and served as the Casenote/Quantum Study Editor.  She has been admitted to practice in all Louisiana state courts, the United States District Court for the Eastern District of Louisiana, the United States District Court for the Middle District of Louisiana, the United States Court of Federal Claims, the United States Court of Appeals for the Fifth Circuit, the United States Court of Appeals for the Federal Circuit, and the United States Supreme Court.

She represents individuals, privately held businesses, professionals and real estate investors, as well as homeowners and condominium associations.  She acts as general counsel to a number of professionals and small businesses, advising them on general business and insurance matters and representing them in real estate transactions, litigation, arbitration and mediation.  She has represented the State of Louisiana, the Louisiana Attorney General, the Louisiana Department of Revenue and Taxation, the Terrebonne Parish School Board, and the Republic of Panama.

Michelle is a member of the Louisiana State Bar Association and serves on the board of the St. Thomas More Catholic Lawyers Association.

Notable cases:
  • Served as co-counsel in $591 million verdict against tobacco companies for payment for the 10-year program in Louisiana to promote smoking cessation.
  • Served as co-counsel for the State of Louisiana in national settlement against the tobacco industry for damages caused by smoking. Louisiana's portion of the national settlement was $4.6 billion.
  • Represented hundreds of oyster farmers damaged by the Caernarvon Freshwater Diversion Project in Albert J. Avenal, Jr., et al  v. State of Louisiana Department of Natural Resources.
  • Represented the State of Louisiana, the Louisiana Attorney General and the Louisiana Department of Revenue and Taxation in litigation against oil refineries throughout the state for back due use taxes.

Mark G. Duncan began practicing in New York City in 1994, starting his legal career with Aaron Richard Golub and later with Menaker & Herrmann.  He spent the first 10 years of his practice in Manhattan before returning to his hometown in Louisiana.  He has a broad background in civil litigation and transactional work, including complex commercial litigation, construction and real estate litigation, employment law and commercial collections, to name a few.  Mark returned to Louisiana in 2004, immediately resuming his legal career at Metairie-based Dwyer & Cambre, where he emerged to head the litigation department before founding the Firm.  His practice there was concentrated on real estate and related litigation and construction disputes, representing contractors and developers on hotel and industrial construction projects.   Mark is a graduate of Louisiana State University and the University of Arkansas School of Law. He is a member of the Louisiana State Bar Association and the New York City Bar Association.  He is admitted to practice before all Louisiana courts, the United States District Court for the Eastern District of Louisiana, as well as all New York State courts and the United States District Court for the Southern District of New York.

Notable cases:

  • Successfully defended an engineering firm in litigation arising out of a public works project to raise roads and prevent tidal flooding in a coastal Long Island village. 
  • Successfully defended multinational insurance broker in litigation arising out of denial of coverage by carrier.
  • Successfully represented bankruptcy trustee in adversary proceedings against debtor and debtor-related entities, including claims based on fraudulent transfers, claims to pierce the corporate veil of debtor’s entities, and claims based on the civil racketeering statutes.
  • Successfully represented individual in action to enforce oral agreement to share profits from financial advisory project undertaken to raise financing for oil refinery located in Lithuania.
  • Appointed by bankruptcy court to collect on accounts receivable of debtor, managing voluminous collection files and successfully collecting over $2 million on past due accounts for bankruptcy estate.
